Terms of Service

These Terms of Service ("Terms") govern access to and use of Brand-Check AI (the "Service"), offered by Brand-Check AI. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Operator: Brand-Check AI. For product support, use the contact or receipt channel provided by Lemon Squeezy on your order confirmation, unless we list an address elsewhere on this site.

The Service provides automated visual brand audits based on images or captured previews you supply, including optional generation of extended narrative reports and PDF deliverables where purchased. Output is generated using third-party artificial intelligence and is inherently probabilistic. The Service does not guarantee accuracy, completeness, fitness for a particular purpose, or any particular commercial outcome.

You represent that you have legal capacity to enter these Terms. The Service may be used without a standing user account; certain flows rely on your browser storage and cookies. You are responsible for keeping your session and devices secure.

You retain your rights in materials you upload or link for audit. You grant Brand-Check AI a non-exclusive, worldwide, royalty-free licence to host, process, transmit to subprocessors (see Privacy Policy), and analyse such content solely to operate and improve the Service and to generate outputs for you. You warrant you have all rights necessary to submit the content and that it does not violate applicable law or third-party rights.

• No unlawful, harassing, defamatory, or rights-infringing use.
• No attempt to probe, disrupt, or overload our systems or third-party APIs.
• No automated scraping of the Service beyond ordinary browsing.
• No circumvention of technical or payment controls (including PDF access gates).
• No submission of images you are not entitled to analyse or distribute.

Paid offerings (including "Sovereign"-style executive reports) are sold via Lemon Squeezy or another designated payment processor. Prices, taxes, receipts, chargebacks, and processor terms are governed by that relationship. Access to paid deliverables may require successful payment verification via our technical controls (including signed cookies). We may refuse service where fraud or abuse is suspected.

The Service, its branding, software stack, prompts, and pre-existing materials belong to Brand-Check AI or its licensors. Subject to your rights in your inputs, we grant you a limited, non-exclusive, non-transferable licence to use outputs generated for you in accordance with these Terms and applicable law.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUTPUTS DO NOT CONSTITUTE LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. YOU RELY ON THEM AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Brand-Check AI AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED GBP (£100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

You will defend and indemnify Brand-Check AI against third-party claims arising from your content, misuse of the Service, or breach of these Terms, including reasonable legal fees.

We may suspend or terminate access where reasonably necessary for security, law, or breach of these Terms. Provisions that by nature should survive (disclaimer, liability limits, indemnity) shall survive.

We may modify these Terms by posting an updated version with a new "Last updated" date. Continued use after changes constitutes acceptance. Material changes may, where required, be communicated as described in our Privacy Policy or at checkout.

These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules. Courts located there shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
